Oscar Rene Gutierrez is a personal injury trial lawyer at the Law Offices of Oscar H. Gutierrez, APC. Oscar Rene currently practices law as a trial lawyer with his father Oscar H. Gutierrez. Growing up with trial lawyer for a father, Oscar Rene’s dream since youth was also to be a trial lawyer, assisting those injured or killed by the negligence of others.

An Experienced Personal Injury Trial Lawyer:

Soon after receiving his license to practice law in 2011, Oscar Rene was selected to participate in the Los Angeles chapter of the American Board of Trial Advocates (ABOTA) Jack Daniels’ Trial School. As a new lawyer, Oscar Rene earned high marks from his instructors and defeated attorneys from very prestigious Los Angeles firms in mock trials.

In 2012, Oscar Rene enrolled in the Los Angeles City Attorney’s Office “Academy of Justice” six-week trial advocacy program. After completion of the program, he served as a Reserve Deputy City Attorney for the City of Los Angeles for approximately six months. Oscar Rene “first-chaired” numerous jury trials, prosecuting cases against well-known public defenders and accomplished private criminal defense attorneys.

Currently, 90-95% of his cases involve personal injury matters, assisting the injured. In his few years of practice, Oscar Rene himself has successfully litigated cases involving:

Oscar Rene actively participates in all phases of personal injury litigation – writing demands, drafting complaints, taking depositions, defending depositions, writing/arguing discovery motions, conducting jury trials, and writing/arguing post-trial motions. He is well versed in law and motion, having defeated demurrers, summary judgment motions, and motions to strike. Oscar Rene also has extensive experience resolving cases through alternative dispute resolution methods, such as mediation and settlement conferences. Oscar Rene also has successfully resolved several cases via the underinsured/uninsured motorist arbitration process.

There is no defendant too large or intimidating, as Oscar Rene regularly files claims and lawsuits against insurance companies, public entities, retailers, municipalities, auto makers, amusement parks, and common carriers. He is a trial lawyer and is not afraid to go to trial.

Oscar Rene has resolved numerous cases for more than $100,000. Additionally, he has successfully resolved many cases for the policy limits.

Professional Involvement and Leadership

Oscar Rene remains involved in several professional organizations in southern California.

He currently serves as Treasurer for the Mexican American Bar Association of Los Angeles County. This will be his third year on the MABA Board of Trustees, where he is part of the both the Judicial Endorsement and Political Endorsement Committees. Oscar Rene regularly organizes and participates in complimentary community legal fairs, providing legal assistance and services to low-income and immigrant communities throughout Los Angeles County.

Oscar Rene also serves as Co-Chair of the Membership Committee for the Litigation Section of the Los Angeles County Bar Association (LACBA). At LACBA, Oscar is also a member of the Committee on Adequate State Court Funding.

Oscar Rene is a proud member of the Consumer Attorneys Association of Los Angeles (CAALA). He regularly participates in CAALA-sponsored workshops, seminars, and classes to stay current with changes in law and procedure and to improve his trial and advocacy skills.

He also serves on the board for the Latino Alumni Society of Loyola High School of Los Angeles.

Languages:

Oscar Rene is the son of Mexican immigrants from Guadalajara and La Barca, Jalisco. He is completely fluent in both English and Spanish.

Education:

Oscar Rene attended Loyola High School of Los Angeles. He graduated in 2002, with honors.

After graduating from Loyola High School, he attended the University of Southern California (USC) where he graduated in 2006 with degrees in Communication and Chicano Studies, cum laude. He also obtained an academic minor in Spanish. While at USC, Oscar Rene was named to the Dean’s List on eight separate occasions. He was a member of the following honors societies: Blackstonians Pre-Law Honor Society, the Latino Honor Society, and Lambda Pi Eta – the official honor society of the National Communication Association. Oscar Rene was also recognized as a finalist for the 2006 Hubbard Award by the Mexican American Alumni Association and was named a Renaissance Scholar upon graduation. Apart from his studies, he also successfully completed internships at the Mexican-American Legal Defense and Education Fund (MALDEF) as well as the National Association of Latino and Elected Appointed Officials (NALEO). In the summer of 2005, Oscar Rene was selected to work at the American Chamber of Commerce in Mexico City, where he worked on creating and editing content for Business Mexico magazine.

After USC, Oscar Rene then enrolled at Pepperdine University School of Law as a Diversity Scholar. While at Pepperdine, he served as a judicial extern for the Honorable Ronald S.W. Lew, United States District Court Judge for the Central District of California in the summer of 2008. He also completed two separate externships at the Los Angeles County District Attorney’s Office – working in both the Hardcore Gang and Family Violence Units. In the fall of 2008, he participated in Pepperdine Law’s International Moot Court Competition in London, England, where he mooted against prospective barristers at the Royal Courts of Justice. Additionally, Oscar Rene was part of a two-person team that received the award for Best Respondent’s Brief at Pepperdine Law School’s 2010 Dalsimer Moot Court Competition. Oscar Rene also served as the Legal Summaries Editor for Pepperdine’s administrative law journal, the National Association of Administrative Law Judiciary, where he was twice published for his Legal Summaries.

From 2009-2010, he served as the MABA Student Vice Chair for Pepperdine and as the President of the Latin American Law Student Association (LALSA).
