A Tarrant County jury returned a $16.3 million dollar verdict in favor of Plaintiff, Clarence Johnson, represented by Payne Mitchell Ramsey. The product liability case involved an air conditioning compressor and components designed and sold by Emerson Climate Technologies and Fusite. The defendants’ compressor failed, spewing pressurized hot flaming oil onto Mr. Johnson’s face, neck and torso. The case was tried in the 48th District Court of Tarrant County, the Honorable David Evans presiding. Clarence Johnson was represented by Andy Payne, Todd Ramsey and Stefanie Bradshaw of Payne Mitchell Ramsey.

Andy Payne, Todd Ramsey and Stefanie Bradshaw obtained a jury verdict of $2.6 million in Komar v. Hiemsta where our client was severely injured when struck by a vehicle in a pedestrian crosswalk.

Andy Payne and Stefanie Bradshaw resolved an apartment drowning case. Apartments are required to have gates with latching. There is one purpose for this requirement —preventing children from drowning. Payne Mitchell Ramsey was able to prove that the apartment in question had inoperable latches. Moreover, Payne Mitchell Ramsey showed that the apartment tried to hide that fact and destroyed evidence. By uncovering these actions, we were able to settle our client's case for a substantial sum. The case also resulted in the apartment management company rewriting their policies regarding replacement of bad latches at numerous properties.

Andy Payne and Stefanie Bradshaw settled a defective medical product case. Payne Mitchell Ramsey's client underwent a back surgery that involved the installation of metal hardware placed onto his spine. However, a defective locking mechanism allowed the hardware to repeatedly fail long after the initial surgery. Payne Mitchell Ramsey proved the defect and the fix, which resulted in a positive product redesign and a large award for their client.

Andy Payne and Stefanie Bradshaw successfully resolve a road construction equipment case. Payne Mitchell Ramsey represented an equipment mechanic who was performing routine repairs on construction equipment when a defect led to the traumatic amputation of his arm. We discovered “smoking gun” documents that revealed that the company was aware of the defect, but chose not to implement the fix. Their case resulted in a life-changing settlement for our client, and they are pleased that as a result of the case, the company has changed their product design.
