Mr. Day has been licensed as a trial attorney for more than 30 years. Mr. Day is a board certified as a civil trial specialist by the National Board of Trial Advocacy and has board certification in Civil Pretrial Practice Advocacy by the National Board of Legal Specialty Certification. To obtain these certifications, Mr. Day demonstrated his abilities through handling numerous personal injury and accident claims, including car and accident litigation, slip and fall lawsuits business litigation, and insurance claims, as well as various other types of civil litigation. Mr. Day is also board certified by the American Board of Professional Liability Attorneys as a Diplomate in legal malpractice. Mr. Day had to draw upon his experience in personal injury and accident claims, motor vehicle accidents, real estate litigation, wills and probate litigation, and business lawsuits to know what the attorney standard of care should demand of lawyers representing individuals and businesses. In order to obtain board certification in legal malpractice, Mr. Day also had to demonstrate his proficiency by handling numerous legal malpractice lawsuits. Mr. Day’s home office is located in Cookeville, Tennessee, at the foot of the Cumberland Plateau. He has handled hundreds of cases in Putnam County, well as the surrounding counties (including White County, Cumberland County, Fentress County, Clay County, Pickett County, Jackson County, Warren County, Overton County, Dekalb County, Smith County and Wilson County). In his litigation career, Mr. Day has also handled cases from the Tri-Cities in East Tennessee to Jackson in West Tennessee, and from Byrdstown in Northern Tennessee to Chattanooga in Southern Tennessee. These include many cases in Nashville, Knoxville and Chattanooga. As a case merits his time and travel, Mr. Day has shown he is willing go to areas in diverse locations across Tennessee to assist those with serious injuries or significant litigation. Mr. Day graduated magna cum laude with a Bachelor of Arts degree from East Tennessee State University in 1980. He earned his Bachelor’s degree in just 15 months. His honors and activities included membership in Phi Kappa Phi and Alpha Lambda Delta honor societies. While he was attending East Tennessee State University, Mr. Day was also enrolled at the University of Tennessee in 1980 as a special student in Chinese. He earned all credits by examination. Mr. Day attended law school at the University of Tennessee College of law, and in May 1984, Mr. Day earned a Doctor of Jurisprudence degree with high honors and in the top 10% of class. While in law school, Mr. Day also served as an assistant editor for the Tennessee Law Review. Mr. Day has practiced in a general civil practice with primary emphasis on personal injury, car and truck claims, attorney malpractice, creditor bankruptcy representation, and commercial, real estate, contract and business practice and litigation. Licensing: State Courts: Mr. Day was admitted to practice law in Tennessee in 1984, and is licensed to practice in every Tennessee state court, including the Tennessee Supreme Court and the Tennessee Courts of Appeal. Federal Courts: Mr. Day is admitted to practice in the U.S. District Court for the Middle and Eastern Districts of Tennessee, as well as the United States Bankruptcy Courts of the Middle and Eastern Districts. He was admitted to practice before the U.S. Circuit Court of Appeals for the Sixth Circuit in 1990. In that same year, he was also admitted to practice before the United States Supreme Court.
