Kim Loutey represents plaintiffs exclusively, with a focus on complex litigation, wrongful death, catastrophic injury, and medical malpractice. Ms. Loutey has a wide range of experience in civil litigation on behalf of injured persons, including in cases involving labor and delivery malpractice, OSHA violations, transportation accidents, civil rights violations, brain injuries, and spinal injuries. She has been part of the trial team for cases involving misdiagnosis malpractice, workplace injuries, and complex product liability.
For example, Ms. Loutey developed the legal and factual strategy for holding one of the largest companies in the world responsible for turning a blind eye to the safety of a third-party contractor working in their facility, which recklessness caused the worker to suffer a devastating injury that left them in a medical coma for two months. Over the companyâ€™s repeated and strenuous objections, the court allowed the case to proceed to trial. In a recent case involving a universityâ€™s failure to follow the concussion protocol, the university moved the case to federal court, only to immediately agree to send it back to state court when they received her brief.
Ms. Loutey is a graduate of Villanova University School of Law, Wellesley College (B.A., Political Science and Economics), and Academy of Notre Dame de namur. While at Villanova, she participated in the Intensive and Advanced Trial Advocacy Classes, and was a member of the J. Willard Oâ€™Brien American Inn of Court, which she continues to be a member of today. While at Wellesley, she spent a semester abroad at the University of St. Andrews studying International Relations.
At a prior large plaintiffâ€™s firm, Ms. Loutey managed the resolution of the firmâ€™s DePuy Hip Implant and Pradaxa cases, resulting in successful settlements (including getting denials by claims processors reversed) for cases involving wrongful death, brain injuries, and permanent disability.
