Timothy J. RECENT TRIAL VICTORIES
Fadely v. Encompass Health: a judge awarded damages against a rehabilitation center totaling $1,693,273.24. Brought under Arizona’s Adult Protective Services Act, the case is believed to be the only civil trial which took place in Arizona state courts during the 2020 pandemic.
Kunasek v. Roadrunner Trust et al.: a unanimous jury awarded $21,000,000.00 in damages in favor of Tim’s client and against a set of trustees and their lawyers for breach of fiduciary duty after the defendants created a plan to unlawfully reduce a beneficiary’s interest in the trust.
Rodriguez v. Planned Parenthood: a unanimous jury awarded $3,000,000.00 in damages in favor of Tim’s client, a former clinic manager who sued for retaliatory discharge and intentional infliction of emotional distress after she made internal reports alleging that her employer violated health and safety laws designed to protect women.
