Timothy J. Mr. Casey is a highly experienced trial lawyer who has achieved record-setting verdicts for his clients.  He is widely regarded as one of Arizona’s preeminent trial attorneys and is regularly named a “top lawyer” by numerous independent and peer-review organizations.

Over the last three decades, Tim has litigated and tried complex civil jury trials across Arizona and the United States.  His experience in high-stakes cases spans multiple areas of law, including plaintiff’s commercial litigation, breach of fiduciary duty, aiding and abetting, legal and accounting negligence, officer and director liability, defective products, intellectual property, nursing home wrongdoing, police misconduct, medical negligence, serious personal injury and wrongful death claims, and employee whistleblower lawsuits.  Because of his extensive involvement in campaign finance and election law, Tim also has a long history of representing businesses, citizens, campaigns, candidates, and elected officials.

RECENT TRIAL VICTORIES

Fadely v. Encompass Health: a judge awarded damages against a rehabilitation center totaling $1,693,273.24.  Brought under Arizona’s Adult Protective Services Act, the case is believed to be the only civil trial which took place in Arizona state courts during the 2020 pandemic.

Kunasek v. Roadrunner Trust et al.: a unanimous jury awarded $21,000,000.00 in damages in favor of Tim’s client and against a set of trustees and their lawyers for breach of fiduciary duty after the defendants created a plan to unlawfully reduce a beneficiary’s interest in the trust.

Rodriguez v. Planned Parenthood: a unanimous jury awarded $3,000,000.00 in damages in favor of Tim’s client, a former clinic manager who sued for retaliatory discharge and intentional infliction of emotional distress after she made internal reports alleging that her employer violated health and safety laws designed to protect women.
