Abigail M. Cody is an attorney in Milberg’s ERISA and fiduciary litigation practice, where she advocates on behalf of plan participants and beneficiaries in complex employee benefits and retirement plan disputes. She joined Milberg in early 2026, after building her career in the financial services industry with a focus on ethical, humane corporate representation.

Ms. Cody brings substantial litigation experience representing financial institutions, lenders, and organizational clients across a wide range of matters, including consumer lending, small business litigation, and issues involving non‑profit organizations. Her prior practice provided her with a nuanced understanding of corporate decision‑making, regulatory pressures, and fiduciary responsibilities—experience that now informs her plaintiff‑side ERISA advocacy and commitment to accountability and transparency.

Before joining Milberg, Ms. Cody practiced as an associate attorney at Weltman, Weinberg & Reis Co., LPA, a national firm concentrating on creditors’ rights and financial services litigation. There, she handled cases through all phases of litigation and advised sophisticated institutional clients. She was recognized internally for her professionalism and contributions to the firm during her tenure, including receiving client commendations for excellence in trial practice in 2024 and 2025.

Ms. Cody earned her Juris Doctor from Capital University Law School and is admitted to practice in Ohio (2022) and Illinois (2025), as well as before the United States District Court for the Southern District of Ohio (2022).

In addition to her legal practice, Ms. Cody is deeply committed to advocacy, service, and community engagement. She has a longstanding record of supporting charitable and mission‑driven organizations—through donations and service—to the International Rescue Committee, The Thirst Project, Operation Smile, Medecins Sans Frontieres, the Delaware Bar Association’s Andrew’s House initiative, the World Wildlife Fund, the Parks Project, and the Good Neighbors Picnic, as well as many years serving the Ohio Women’s Bar Association, the Women Lawyers of Franklin County, and Capital University’s women‑in‑law initiatives. Her advocacy reflects a belief that effective legal representation and meaningful civic engagement go hand in hand.

Ms. Cody is an active resident of the Short North Arts District in Columbus, Ohio, where she lives with her family. She is the parent of two young children who attend a local Montessori school, with which she remains actively involved and supportive. Her connection to her community informs both her professional values and her approach to client advocacy.
