Josh is an experienced trial and appellate lawyer concentrated on litigating technologically complex criminal and civil cases. TechCrunch has described his combined trial skill and technical expertise as "a rare skill for those in the legal profession." Through his expertise and meticulous trial preparation, Josh has achieved outstanding results for his clients in extraordinarily difficult and complex matters.
He has also achieved appellate success, most recently obtaining the reversal of a grant of summary judgment at the Appellate Division, Second Department in the State of New York. He has also briefed and argued appeals at the United States Court of Appeals for the Second Circuit and other New York State appellate courts.
In 2019, Josh was counsel in a murder trial in which his client was fully acquitted of all charges. Through his meticulous cross-examination of the government's cell phone and computer forensics experts, Josh was able to raise doubt about the integrity of the government's evidence and investigation, resulting in a total acquittal.
As a testament to his deep technical expertise, Josh has been qualified as an expert witness in cyber / computer forensics in state and federal courts around the United States, including in the Middle District of Florida, the Northern District of Illinois, the Northern District of California. He has also been appointed as a computer forensics expert by the federal judiciary under the Criminal Justice Act in the Southern District of New York and in the District of Massachusetts.
Josh also serves as trial counsel in high-stakes civil matters involving business and commercial litigation. He has achieved outstanding results by securing highly favorable settlements or jury verdicts.
In recognition of his expertise in federal criminal practice, Josh has been selected by the federal judiciary and his peers to serve on the Eastern District of New York's Criminal Justice Act ("CJA") Panel. This honor is reserved for lawyers who have demonstrated the highest competence in all aspects of federal criminal practice, including the Federal Rules of Criminal Procedure, the United States Sentencing Guidelines, Federal Rules of Evidence, and all aspects of federal criminal trial practice.
He has successfully obtained dismissals, acquittals, and/or favorable dispositions in a broad variety of state and federal criminal matters, ranging from Murder, to Racketeering prosecutions (RICO), sex crimes, assaults, money laundering, computer fraud and other offenses. He also has experience and expertise in matters involving international extradition to the United States from foreign jurisdictions.
