…your own expert witness unexpectedly makes a disastrous mistake during their deposition – creating a crisis for your case and potential testimony for the defense. Join us as veteran medical malpractice attorney Katherine Cárdenas of Lucas and Cárdenas, P.C., in Chicago describes how to abandon your own expert witness and preserve your case.

Ms. Cárdenas found herself in this situation with a certified expert who had excellent medical credentials. In fact, the expert had just testified in a case that settled for $20 million. However the witness turned out to be inexperienced with legal procedure. Even though she had been carefully prepped, the witness managed to impeach herself by getting caught in a lie.

State courts have a procedure for abandoning a witness, and if done properly, the defense cannot use the testimony against you. Attorney Cárdenas will cover:

  • When plaintiff’s burden of proof requires expert testimony.
  • The expert witness disclosure process.
  • The deposition of your expert.
  • The mechanics of the abandonment process.

About Katherine Cardenas

Ms. Cárdenas has more than 20 years of experience representing adults and minors who have suffered debilitating injuries in every area of personal injury. She is a member of the highly esteemed Million Dollar Advocates Forum due to her repeated success in winning multi-million dollar settlements for her clients. She is also a member of The National Trial Lawyers Top 100 Trial Lawyers. She prides herself on tenaciously representing her clients from day one to the very end.

She is an Indiana University graduate and obtained her law degree from Loyola University School of Law Chicago. Ms. Cárdenas has tried numerous cases in Cook County, Will County, and Lake County, Illinois. She has represented clients in Federal Court and has argued before the Supreme Court of Illinois. Ms. Cárdenas is a member of the Illinois State Bar Association, the American Association for Justice and the Illinois Trial Lawyers Association.
