The 22-year-old man was driving his Mazda sedan north on US 1/Capital Boulevard through Raleigh when the driver of the box truck ran a red light, T-boning the driver’s side of the sedan.

RALEIGH, NC — The personal injury firm of Marcari, Russotto, Spencer & Balaban P.C., serving clients in North Carolina, South Carolina and Virginia, recently negotiated a settlement of $1 million for the estate of a young Raleigh resident killed in an accident with a box truck on July 13, 2015.

In that accident, the 22-year-old male was driving his Mazda sedan north on US 1/Capital Boulevard through Raleigh when the driver of the box truck ran a red light, T-boning the driver’s side of the sedan.

The driver of the Mazda sustained critical injuries and succumbed two days after the crash. The cause of death was determined to be traumatic subdural hematoma, or brain hemorrhage. Other injuries suffered included traumatic pneumothorax, acute respiratory failure following trauma surgery, traumatic shock, acute posthemorrhagic anemia and brain death.

The family of the deceased driver retained Marcari, Russotto, Spencer & Balaban P.C. to represent them in his wrongful death claim. David Spencer, the firm’s Raleigh partner, established liability on the part of the defendant and entered voluntary mediation to arrive at the $1 million settlement.

Attorney David Spencer commented, “We are gratified to have been able to settle this case in a very timely manner. While no amount of money is ever adequate compensation for the loss of a loved one, the settlement is fair under the laws of North Carolina and provides closure for this grieving family.”
