A lawsuit filed against Flint and two firefighters after two boys died following a delayed rescue from a burning home has survived its first legal hurdle in Genesee Circuit Court.
Judge B. Chris Christenson said during a court hearing on Monday, May 1, that he won’t immediately consider motions for summary disposition filed by the city and two former firefighters, the targets of the lawsuit. The filing seeks $50 million in damages.
Attorneys for the city and former firefighter Daniel Sniegocki argued Monday that governmental immunity protects their clients from the lawsuit, but Christenson said he would hold those motions in abeyance at least until discovery begins to unfold in the case.
